PERSONAL DATA PROCESSING INFORMATION CLAUSE


In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR), please be advised of the rules for the processing of your personal data for the purpose of concluding and performing contracts, meeting legal obligations, pursuing legitimate interests and on the basis of consents granted, and your rights related thereto. The following rules apply as of 25 May 2018.

  1. The Controller of your personal data is TORPOL Oil & Gas Sp. z o.o. with its registered office in Wysogotowo, ul. Długa 5, 62-081 Przeźmierowo, e-mail: info@torpoloilgas.pl, hereinafter referred to as the "Controller".
  2. In matters relating to your data, please contact the Data Protection Officer, e-mail: iod@torpoloilgas.pl.
  3. Your data that has not been obtained directly from you was obtained by the Controller from your employer, to whom you have given your consent to the transfer of the data.
  4. Your data processed by the Controller that has not been obtained directly from you may include: names and surname, company name, telephone number, e-mail address, qualifications, job position, professional experience.
  5. The Controller processes your data in accordance with the provisions of the GDPR and Polish data protection regulations. Your data will be processed on the basis of Article 6(1)(a), (b), (c) and (f) of the GDPR for one or more of the following purposes:
    1. fulfilling legal obligations of the Controller to the extent stipulated by law;
    2. concluding and performing contracts;
    3. pursuing legitimate interests of the Controller, including in particular:
      • establishing a business relationship (including, but not limited to, submitting a request for proposal or offer),
      • performing a contract concluded between the Controller and their business partner for whom you perform services directly or indirectly,
      • ensuring, in connection with the Controller's business activity, efficient communication between all entities cooperating with each other, in particular at the stage of quotation, conclusion of contracts and their performance,
      • verifying business partners in order to prevent criminal offences, including fraud,
      • establishing or asserting claims or defending against claims.
  6. Your data may be shared with other parties in order to comply with a legal obligation incumbent on the Controller or for purposes arising from the legitimate interests of the Controller or a third party. The recipients of your personal data may be in particular:
    1. institutions or third parties entitled to request access to or receive personal data under relevant provisions of the law,
    2. entities providing consultancy and control services to the Controller, e.g. auditing companies,
    3. entities acting on behalf of the Controller in order to assert the Controller's rights (e.g. external law firms),
    4. banks which keep your bank account or the Controller's bank accounts,
    5. entities which provide the Controller with insurance services or from whom the Controller will claim damages,
    6. other entities which the Controller uses in the course of its business activity and to which it entrusted the processing of personal data under personal data processing entrustment agreements or other similar agreements.
  7. Your data will be stored for the period necessary to fulfil the purposes of the processing referred to in section 3 above or until the end of the period during which the Controller is obliged to prove the fulfilment of obligations provided for in relevant provisions of law or until the end of the limitation period.
  8. Your personal data will not be transferred to third countries, i.e. outside the European Union.
  9. Your personal data will not be processed in an automated manner (including profiling) that may produce legal effects for you or significantly affect you otherwise.
  10. You have the right to:
    • request access to your data (to the extent specified in Article 15 of the GDPR),
    • request the rectification of your data (to the extent specified in (Article 16 of the GDPR),
    • request the erasure of your data (to the extent specified in Article 17 of the GDPR),
    • request the restriction of the processing of your data (to the extent specified in Article 18 of the GDPR),
    • data portability (to the extent specified in Article 20 of the GDPR),
    • object to the processing of your data (to the extent specified in Article 21 of the GDPR).
  11. To the extent the processing will take place on the basis of your consent, you have the right to withdraw the consent at any time. The withdrawal of your consent does not affect the lawfulness of the processing prior to the withdrawal of your consent.
  12. You have the right to lodge a complaint with the President of the Office for Personal Data Protection if you think that the processing of your data violates the provisions of the applicable law.
  13. To the extent your data have been collected directly from you, providing your data is voluntary.
